Uncontested Divorces

Uncontested Divorces

Divorce can be a complicated and emotional process, but it doesn't always have to involve protracted and contentious court battles. In fact, most divorces are settled amicably and without the need for court appearances. In this article, we will explain the difference between contested and uncontested divorce and the requirements for obtaining an uncontested divorce in Virginia. We will also provide information on the costs involved.

Divorce can be either uncontested or contested. An uncontested divorce means that the couple agree to all the major issues such as child custody, child and spousal support (alimony), property division, and other matters. On the other hand, a contested divorce occurs when the couple does not agree on one or more of these issues, and the court must determine the outcome.

It's important to note that a divorce may start as contested but become uncontested if the spouses work out their disagreements. Conversely, a divorce may start as uncontested and turn into contested if there is no agreement.

If you want to obtain an uncontested divorce in Virginia based on a six-month separation, there are certain requirements you must meet. For example, you must not have any minor children and have a separation agreement. Additionally, one of you must have lived in Virginia for at least six months.

If you cannot meet the above requirements, you can still obtain a divorce in Virginia if you have lived separately for at least one year, and one of you has lived in Virginia for at least six months. A separation agreement is not required, but it's a good idea.

The cost of an uncontested divorce in Virginia varies depending on the circumstances.

If your spouse agrees to have an uncontested divorce and signs all necessary documents, the cost is $750 plus $98 court costs. If your spouse has moved away, and you are not in touch, but you have your spouse's prior address, the cost is $850 plus $98 court costs. Finally, if your spouse has moved away, and you do not know where they are or have their address, the cost is $950 plus $98 court costs. In this situation, service must be by publication in a newspaper, which is an additional cost.

Divorce doesn't have to be a long and contentious process. Understanding the difference between contested and uncontested divorce, as well as the requirements and costs involved in obtaining an uncontested divorce in Virginia, can make the process smoother and less stressful.
